Terms of Service

1. Who we are

Ember is a local content marketplace operated by Igniter Digital (“Ember”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of the Ember website and platform (the “Service”).

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you have authority to bind that business.

2. Accounts

You must provide accurate information when registering and keep your account credentials secure. Accounts are free to create for both creators and businesses.

You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms, misrepresent identity, or abuse the platform.

Creator profiles must not include contact information, external links, or other content intended to route business off-platform. We may remove profile content that violates this policy.

3. Embers, claiming, and deadlines

A business posts an “Ember” — a paid content opportunity with a creative brief, deliverables, a reward, and a completion deadline (24 hours, 48 hours, 72 hours, or a custom window up to 7 days).

When a creator claims an Ember, they commit to delivering the brief by the stated deadline. Missing a deadline without an approved revision or extension may result in forfeiture of the reward for that Ember.

Businesses may edit an Ember only before it is claimed. Once claimed, the brief, reward, and deadline are locked except through the platform’s revision workflow.

4. Rewards, fees, and payments

Businesses set the creator reward for each Ember, subject to a $75 minimum. Ember charges businesses a 20% platform fee on top of the reward.

Creators keep 100% of the displayed reward. Rewards become payable when the business approves the submitted content.

Payments and payouts are processed through our payment partners. You authorize us to charge the payment method on file for approved Embers and associated fees.

5. Content rights and usage

Upon approval and payment, the business receives usage rights to the delivered content as recorded on the Ember. Creators retain ownership of their work until rights transfer on approval.

Creators represent that submitted content is their original work, does not infringe third-party rights, and complies with the brief.

You grant Ember a limited license to host, display, and transmit content solely to operate the Service.

6. Acceptable use

You agree not to: post unlawful, defamatory, or infringing briefs or content; circumvent platform payments; harass other users; scrape or reverse engineer the Service; or use the Service for any purpose that violates applicable law.

7. Disclaimers and liability

The Service is provided “as is” without warranties of any kind. Ember is a marketplace and is not a party to the agreement between a business and a creator, though we facilitate briefs, deadlines, and payments.

To the maximum extent permitted by law, Igniter Digital’s aggregate liability arising from the Service is limited to the platform fees you paid in the twelve months preceding the claim.

8. Changes and contact

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date.
